Information Collected

When you request additional information or register for services, LogicManager will ask you to provide basic contact information.

LogicManager uses common Internet technologies, such as cookies and Web beacons, to keep track of interactions with LogicManager’s websites and emails.

Use of Information

LogicManager uses information collected to provide you with the services you request. LogicManager may use information collected to provide you with additional information about LogicManager’s services, promotions, and events. LogicManager may use information collected to improve LogicManager’s websites and services. LogicManager does not share, sell, rent, or trade personally identifiable information with third parties for their promotional purposes.

We employ other companies and people to provide services to visitors to our websites, our customers, and users of our software, and may need to share your information with them to provide information, products or services to you. Examples may include removing repetitive information from prospects lists, analyzing data or performing statistical analysis, and providing customer service or support. In all cases where we share your information with such agents, we require the agent adhere to our privacy and confidentiality standards.

Customer Data

Customers of LogicManager use LogicManager’s services to host data and information (“Customer Data”). LogicManager will not review, share, distribute, or reference any such Customer Data except as provided in LogicManager Master Subscription Agreement. Individual records of Customer Data may be viewed or accessed only for the purpose of resolving a problem, support issues, or suspected violation of LogicManager Master Subscription Agreement, or as may be required by law.

Where we process personal information in connection with the provision of our software solutions to our customers, we only collect, process and store personal information to support and provide those solutions. You should refer to the agreements governing your use of those solutions with such enterprises to find out more about how your data is being used by them.

Your Options and Communications Preferences

You have the following data protection rights and options:

You can request access, correction, updates or deletion of your personal information.

You can object to processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information.

If we have collected and process your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

You have the right to complain to a data protection authority about our collection and use of your personal information as described below.

Every marketing email from LogicManager contains instructions on how to opt out of receiving further marketing emails from LogicManager.

US-EU Privacy Shield

LogicManager complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States.  LogicManager has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. In compliance with the Privacy Shield Principles, LogicManager commits to resolve complaints about our collection or use of your personal information. EU individuals with inquiries or complaints regarding our Privacy Shield policy should first contact LogicManager at: privacy@logicmanager.com. We will respond to any complaints as soon as possible and within 45 days.

LogicManager has further committed to refer unresolved Privacy Shield complaints to International Centre for Dispute Resolution – American Arbitration Association (ICDR-AAA), an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit https://www.icdr.org/privacyshield for more information or to file a complaint. The services of ICDR-AAA are provided at no cost to you.

Please note that if your complaint is not resolved through these channels, in certain limited circumstances, a binding arbitration option may be available provided that you have taken the following steps: (1) raised your compliant directly to us using the contact details above and provided us the opportunity to resolve the issue; and (2) raised the issue through the relevant data protection authority and allowed the U.S Department of Commerce an opportunity to resolve the complaint at no cost to you. You have the right to access the personal data we collect about you and to request that we correct, amend, or delete it if it is inaccurate or processed in violation of the Privacy Shield. These access rights may not apply in some cases, including where we must comply with legal requirements or if providing access is unreasonably burdensome or expensive under the circumstances or where it would violate the rights of someone other than the individual requesting access.

Liability for Onward Transfer

LogicManager is required to take certain steps when transferring personal data received from the European Union to third parties (such as including contractual provisions in our third party contracts which require them to provide the same level of protection the Privacy Shield requires and limiting their use of the data to the specified services provided on our behalf).

We take reasonable and appropriate steps to ensure that third parties process personal data in accordance with our Privacy Shield obligations and to stop and remediate any unauthorised processing.

Under certain circumstances, we may remain liable for the acts of third parties who perform services on our behalf in connection with their handling of personal data that we transfer to them (including where we transfer personal data to them pursuant to the Privacy Shield).

Legal Compliance

We reserve the right to access and disclose your information when we believe in good faith that such disclosure is necessary to: (a) enforce legal rights and comply with the law; (b) comply with an order from a government entity or other competent authority, (c) prevent or address potential or actual injury or interference with our rights, property, operations, users or others who may be harmed or may suffer loss or damage; (d) protect our rights, prevent fraud and/or comply with judicial proceeding, court order, or legal process served on LogicManager.

LogicManager is subject to the investigatory and enforcement powers of the Federal Trade Commission in the case of any failure to comply with the Privacy Shield.

Questions or Additional Information

We periodically update this Privacy Policy. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice by sending you an email notification, or if you’re a customer, through a notification in LogicManager.
While we will notify you of any material changes to this Privacy Policy, we encourage you to review this Privacy Policy periodically.
